Greetings Philip Tirone,
I was in a Credit Counselling plan with Discover,USBank, and Bank of America. Paying 400.00 a month. I am two months behind and out of money to pay. I probably am going to be dropped from the plan that had lower interest rates and no late payment fees. I must negotiate with the three companies directly. I hope to have 200.00 a month available to pay divided up for the three. I am trying to negotiate by e-mail as my phone is unreliable ( prepay cell ).I have yet to respond but is my belief that I am in collections. I want to see in writing first what is available from them. I might get overheated over the phone as I no they want an emotional response. What should I say initially. The total debt is 400, 1500, and 13000.

For lawyers that understand the law: This is my scenario, I had a high FICO score of 740. I had 26,000 dollars line of credit with JP Morgan Chase of which I had only used 7,000. Suddenly Chase reduced it to 7,920 citing an overlevarged account that was reported to the bureau as part reason. Suddenly everything was like a domino effect with the rest of the other creditors reducing my limit. Well, with these actions, my FICO took a nosedive. My question is why can't I sue these bastards for destroying my credit. At minimum they are accesories??? Unfortunately there are a lot of people in this country under that predicament. Any advice??

Negotiations require good communication skills and a person should be aware what he is to speak and what he should not.

Dear Philip, Got your call but had cell problems and wasn't able to return your call, but yes, I am from Ensenada and have the El Rey Sol restaurant. My problem is with a 28 year old daughter without a job that was given more than 30,000 dlls in credit line from Saks, this is without a job history, etc. While times were good, her mother helped finance, but as your are aware, tourism to Baja is extremely low, so I can't do much to help. I was authorized to speak to the collections law office and they offered a 25 % cash discount or a 10% payment with 30 payments of 900 per month. What are my daughters options? She doesn't have a job or anything to her name. My question is how do they give sooo much credit to someone in her financial reality. My cell is 858-414-4825, Jean-Loup

Hello, I don't know if you can help me but it's worth a shot. I am currently negociating my cc debt with Chase bank. I'm about 5 months behind on my payments and owe about $8,000. At two months behind I called and was offered a 50% settlement. I figured if they started at 50% I had a real good chance to get an even better settelment. Now I'm 5 months behind and they a not budging on the 50%. I don't know if I should continue to try or just accept the 50%. What would you recomend I do to get a better rate? Is there anything I can do? In your experience is this typical? Any bit of info would be greatly appricated! Thank you in advance.

I had to call my CC co.(Chase Bank) and tell them I could not pay on my credit card debt (in Oct. 2009). Was transferred to a lady who asked questions, which I answered, and she set me up with a pay't of 1/2 of the min. Two days later I was phoned by another person who wanted $100 more and didn't accept my reason my reason for non-payment. I asked if he understood plain english and he hummed & hawed and finally hung up.this was followed by other persons, as many as one a day for a week and then one every 2 days. I finally said I can't pay you 'cause I didn't have the money. As of now I think I'm in collections because the letters and phone calls have stopped and I refuse to talk to the collections people.I'd like to be able to pay these people but the $$$ is not there. I got very sick due to paying the Cr Cd instead of buying food and decided I needed to get well before I could handle this. is there a way to negotiate even tho' I'm in collections?
